1. DEFINITIONS

2. PURPOSE AND SCOPE
The Company provides a virtual marketplace for the Member to purchase tickets to participate in the events organized by the Organizers, through its online electronic commerce platform ("Website") named www.biletiva.com. The company acts as a ticket seller; It is not the owner/organizer/performer of the events on the Website. In this context, the Company has no obligation to control the content provided by real and legal persons who use the Website and to whom tickets are sold for the event, and to investigate whether there is an unlawful activity or other situation regarding this content and the goods or services subject to the content. has no liability.The purpose of this Membership Agreement is to enable the Member to benefit from the services detailed in the Agreement offered by the Company on the Internet and to determine the relevant conditions and the rights and obligations of the parties. By accepting this Membership Agreement, the Member accepts, declares and undertakes that he/she has accepted all kinds of statements made by the Company on the Website regarding the ticket sales service, contents, applications and security and that he/she is obliged to comply with all the matters specified in the said statements.FOR THE AVOIDANCE OF DOUBT, THIS MEMBERSHIP AGREEMENT HAS BEEN CONTRACTED ONLY BETWEEN THE COMPANY AND THE MEMBER; IT ONLY CONTAINS PROVISIONS RELATING TO THE TICKET SALES SERVICE OFFERED BY THE COMPANY TO THE MEMBER. THE LEGAL RELATIONSHIP BETWEEN MEMBERS AND ORGANIZERS IS OUT OF THE SCOPE OF THIS MEMBERSHIP AGREEMENT. THE COMPANY IS NOT RESPONSIBLE IN ANY WAY FOR THE LEGAL RELATIONSHIP BETWEEN MEMBERS AND ORGANIZERS, THE RIGHTS AND OBLIGATIONS THAT THIS LEGAL RELATIONSHIP AFFECTS TO THE PARTIES, AND THE PROPER FULFILLMENT OF THESE RIGHTS AND OBLIGATIONS BY THE PARTIES. MEMBERS WILL BE ABLE TO EXERCISE ALL THEIR RIGHTS ARISING FROM THE LAW NO. 6502 ON CONSUMER PROTECTION AND OTHER LEGISLATION WITH REGARD TO THE TRANSACTIONS THEY WILL CARRY OUT WITH THE ORGANIZERS.
3. MEMBERSHIP AND MEMBERSHIP OPPORTUNITIES

Provided that the Member purchases an Event Ticket, he/she can reserve Tickets for his/her friends within the maximum Ticket limit that can be purchased at one time determined by the Event Organizer; These reservations are valid for a limited period of time on Biletiva Digital Channels.j. The Member can purchase his or her Tickets (i) by going to the "My Tickets" option on the sales confirmation screen after the payment confirmation process, (ii) by using the address link sent to the mobile phone or e-mail address registered to the Biletiva Membership account and (iii) always by clicking on the "My Tickets" option under the Biletiva membership account. You can access it by using the option (iv) by receiving the printed ticket from the physical sales point.k. The Member can access the invitations sent by the Event Organizer and matched with the Membership account, and can participate or reject the Events subject to the invitation, if she/he wishes.l. In accordance with the approval of the member, through Biletiva Digital Channels, whether the subject is included in Biletiva Digital Channels or not, general and special campaigns, promotions, promotions, invitations, earning points, giving gift certificates, becoming a member of clubs and discounts, advertisements, surveys, etc. They will be able to benefit from applications and advantages such as and receive information on these subjects, provided that they comply with the conditions to be determined within the scope of the relevant application.m. The Member will be able to change or rearrange all information submitted or approved to be submitted to Biletiva Digital Channels by logging in; If it wishes, it can delete all kinds of information except the fields that are mandatory for membership and those that need to be kept due to legal requirements.Biletiva may integrate with the Event Organizer's business partners in order to ensure, facilitate and diversify the use of membership opportunities and to track the use of the opportunities. The role of Biletiva Digital Channels in the integrated system is only to introduce the Member to the integrated system and verify the user. Within the scope of this integration, the Company can only record the information of transactions passing through its own infrastructure. Information about the integrated system cannot be viewed through the Company system.
4. MEMBER'S OBLIGATIONS AND TERMS OF USE OF BILETIVA DIGITAL CHANNELS
a. Membership is personal and belongs only to the Member. The Member cannot transfer or assign its obligations, rights and receivables arising from this Agreement to a real or legal third party, and cannot transfer or assign another real or legal third party, for any reason, to its responsibilities, rights and receivables recorded in this Agreement and therefore in the relevant legal provisions. He cannot share his receivables.b. The member can benefit from the rights and opportunities offered by Biletiva Digital Channels only as long as her/his membership continues.c. The legal and criminal liability for every transaction and action carried out by the Member within the scope of Membership (including tickets and products purchased, etc. and other opportunities used) belongs entirely to the Member, and the Member may be liable to third parties for activities carried out in violation of the provisions of this Agreement and the law. The Company has no direct or indirect liability for any damages that persons have suffered or may suffer.d. The Member accepts, declares and agrees that he/she is responsible for all damages, malfunctions and any consequences that may occur in his/her software and operating systems due to the use of the Website and other Digital Channels, and not to claim compensation from the Company for any damage he may suffer for this reason. is committed.e. The right to change the content, venue, terms of use, price, value and other information belongs to the provider of the content and opportunity, especially the Company and the Event Organizer.h. Membership terms and conditions may be changed by Biletiva Digital Channels; Membership or Biletiva Digital Channels channel diversity may be increased, decreased or changed at any time.i. New applications such as scoring or loyalty programs, the conditions of which will be freely determined by Biletiva, may be included in Biletiva Digital and Sales Channels.j. Since the company is not the owner, organizer, organizer or performer of the events for which it sells tickets, it is the Organizer's responsibility to ensure that the event is held in accordance with the law and other legislation, and all legal and criminal liability regarding the event belongs to the Organizer. The Organizer is the sole addressee of all claims and demands of the Member regarding the event, especially defective service claims arising from consumer legislation. In this context, the Member cannot make any claims or demands against the Company regarding the service provided by the Organizer.k. The Member is deemed to have accepted that he/she is over 18 years of age and of legal age by approving this Membership Agreement.l. The Member cannot use someone else's IP address, e-mail address, user name and other information while accessing the Website, nor can he access or use the confidential information of other users without permission. Otherwise, all legal and criminal liability belongs to him/her.m. If the Member violates any article of this Agreement, all legal and criminal liability belongs to the Member, and in this case, the Company has the right to terminate this Agreement immediately and unilaterally, without prejudice to all compensation rights.n. In using the Website and in all transactional correspondence carried out on the Website, the Member is bound by the provisions of this Membership Agreement, all conditions stated on the Website, T.R. 5. EVIDENCE CONTRACT
In case of disputes arising from this Agreement, all physical and electronic media and computer records belonging to Biletiva and/or data and records stored in Biletiva Digital Channels, HMK Art. It is binding in accordance with Article 193 and constitutes conclusive evidence.
6. INTELLECTUAL PROPERTY RIGHTS
All kinds of intellectual property rights of all kinds of brands, designs, logos, titles, slogans and all other content created by the Company, as well as the design, software, domain name of the Website, Biletiva Application, Biletiva Digital Channels and all related matters. All rights belong to the Company. The Member acknowledges that the software and design of the Website, Mobile Application, Biletiva Digital Channels and all intellectual property rights on the Website, Mobile Application, Biletiva Digital Channels belong to the Company, and that the Company owns the intellectual property rights of the Company. He accepts, declares and undertakes that he cannot use, share or reproduce in any way without the permission of the Company, and that he will refrain from any behavior that will prejudice the intellectual property rights of the Company, otherwise the Company reserves the right to any compensation.
7. CONTRACT CHANGES
The Company, at its sole discretion, may unilaterally change this Membership Agreement at any time by announcing it on the Website, provided that it is not contrary to the provisions of the applicable legislation. The amended provisions of this Membership Agreement will become valid on the date they are announced on the Website, and the remaining provisions will remain in force and continue to produce their provisions and consequences.
8. DISPUTES
Disputes arising from the contract are subject to the Laws of the Republic of Türkiye and other legislation. Istanbul (Çağlayan) Courts and Enforcement Offices will be authorized to resolve all disputes that may arise between the parties due to the interpretation or implementation of the provisions of this agreement.
9. EFFECT AND DURATION
This Agreement enters into force upon acceptance of the Agreement by the Company and the commencement of membership, and is valid without any time limit until the termination of membership.
10. PERSONAL DATA
By becoming a party to this Agreement, the Member shall be deemed to be responsible for all information given through Biletiva Digital Channels and/or all personal and special personal data given to the Company in any way during the continuation of the membership relationship, and information given/to be given in electronic or other media., By the Company and its partners, business partners, successors and/or third parties determined by them, taking the necessary measures to protect the confidentiality of the said data and complying with the legal principles regarding the processing of personal data and fulfilling the obligations determined by this Membership Agreement, In order to provide and offer various advantages for the Member and to carry out Member-specific advertising, sales, marketing, surveys, all kinds of electronic communication for similar purposes, profiling and statistical studies, it can be acquired and taken over by automatic / non-automatic methods, within the country and/or within the legal periods. or recorded in written/digital archives abroad, to be stored, preserved, made available, used, updated, changed, rearranged, classified, transferred domestically or abroad and processed in any way in accordance with other laws, the Company has been informed about this issue through various channels and has been informed about its legal rights. accepts, declares and undertakes that he/she has expressly given permission (consent/approval) as.In accordance with the legislation in force, the Company may share the Member's information with the authorities upon request by the competent authorities.Regarding your personal data processed within the scope of this Agreement, please review the Personal Data Processing and Protection Policy and cookie policy on the Website.
11. FORCE MAJEURE
Natural disasters, war, fire, decisions taken by the government and unforeseen circumstances that occur beyond the Company's control, which occur in a way that partially or completely, temporarily or permanently stops the performance of the Company's obligations under the Contract, are considered force majeure. The Company is not responsible for such situations and this situation is not considered a violation of the Membership Agreement.
12. MISCELLANEOUS PROVISIONS
12.1. The Company will contact the Member via the e-mail address or phone number provided by the Member when registering. If the Member does not notify the Company of any change in the e-mail address and/or phone number, notifications made to the previously notified e-mail address or phone number will be valid; He accepts, declares and undertakes that he will be deemed to have been notified and that he will be personally responsible for any damages that may occur due to the violation of this obligation.12.2. If any article or provision is invalid or unenforceable, the other articles and provisions will continue to be fully valid.12.3. Failure of either Party to exercise one of the rights mentioned in this Membership Agreement will not mean that it has waived the said right or will not prevent the use of that right in the future.This Membership Agreement, consisting of 12 (twelve) articles, has entered into force between the Parties after each provision has been read and fully understood by the Member and approved electronically.

Delivery
You can obtain your event tickets from Biletiva Sales Points and Event Venue box offices. Ticket delivery is made by the person who purchased the event ticket upon presentation of their reservation number and ID. No refunds or transfers are made for Credit Card collections.
Return and CancellationThere are no refunds or cancellations for event tickets sold. If the event is postponed or canceled for any reason, all responsibility belongs to the organizer company. Biletiva does not accept any liability in such cases.
Biletiva reserves the right to make changes to the Terms of Use and Privacy without prior notice.
Why do I need to create a Biletiva membership registration?

In order to buy tickets to events from Biletiva, you must first create a membership registration. You can create your registration from the "Register" section in the upper right corner of the screen. Tickets for events can only be purchased with a credit card.
After selecting the event you want to buy your ticket for from the mobile application or website, you can purchase it with the proceed to payment button. You can make your payment by bank card. For promotional tickets, you can apply the campaign after adding the ticket to the cart, depending on the campaign type.
